Biblical Man & Biblical Womanhood

1. Scope of Agreement

These Terms of Service ("Terms") govern your access to and use of digital content, products, and donation platforms offered by Biblical Man & Biblical Womanhood ("BM&BW," "we," "us," or "our"). By purchasing, subscribing, or donating, you agree to be bound by these Terms.

2. Covered Services

These Terms apply to:

• Subscriptions: Recurring payments made through Substack

• Digital Products: One-time purchases of downloadable resources (eBooks, PDFs, audio/video content, curriculum, etc.)

• Donations: Voluntary financial gifts made via Buy Me a Coffee, GiveSendGo, Stripe, or other giving platforms

All payments are processed by third-party services (e.g., Stripe) and are subject to their individual terms and conditions.

3. Pricing & Billing

Tier Price Frequency Monthly Supporter $5 Every 30 days Annual Supporter $60 Every 365 days Founder Level $100 Every 365 days

Applicable sales tax, VAT, or GST may be added as required by law.

4. Final Sale of Digital Goods

All digital products and subscription content are final sale and non-refundable once accessed or delivered.

Refunds are issued only in the event of:

• Verified duplicate transactions

• Corrupted or inaccessible files

• Refund obligations imposed by applicable consumer protection laws

We do not offer trial periods or cooling-off periods unless required by law (see Section 7).

5. Subscription Terms

• Auto-Renewal: Subscriptions automatically renew at the listed interval.

• Cancellation: You may cancel through your Substack account. Access remains valid through the current billing cycle.

• Non-Refundable Reasons: Refunds will not be issued for dissatisfaction with content, theological disagreement, or unused access.

6. Digital Product Terms

• Delivery: Access links are provided upon successful payment.

• License: Personal, non-commercial use only unless otherwise stated.

• Error Resolution: Contact us within 7 days for file issues. We may resend or refund at our discretion.

• Non-Refundable Reasons: Change of mind, unmet expectations, or device incompatibility are not valid grounds for refund.

7. Consumer Rights (EU/EEA/UK Customers Only)

Under applicable EU and UK regulations, you may have a 14-day withdrawal right unless you:

• Request immediate access to digital content; and

• Acknowledge that your withdrawal right is forfeited upon delivery

8. Donations

All donations are voluntary, irrevocable gifts.

• Refunds are only issued in cases of proven clerical error or where required by law

• Tax Status: BM&BW is not a U.S. 501(c)(3) and donations are not tax-deductible

9. Chargebacks & Payment Disputes

Before initiating a chargeback, contact thebiblicalman1611@gmail.com and allow 5 business days for resolution.

• Dispute Fees: Stripe deducts the transaction and charges a $15.30 fee per dispute

• If We Win: You agree to repay the $15.30 fee plus a $25 admin charge

• Suspension: Access is suspended during disputes

• Fraud: Knowingly disputing a valid charge may be considered civil fraud. We reserve all legal and administrative remedies.

10. Refund Requests (Where Permitted)

Email thebiblicalman1611@gmail.com with:

• Legal name

• Email used at checkout

• Date, amount, and last 4 digits of payment method

• Reason and documentation

Refund decisions are acknowledged within 2 business days and processed within 10 business days if approved.

11. Recordkeeping

We retain:

• Timestamped server logs

• Consent checkboxes and checkout metadata

• Customer support correspondence

• Payment processor metadata

Retention period: minimum 24 months

12. Data Privacy

All data collected in connection with purchases, refunds, or disputes is handled in accordance with our Privacy Policy and applicable data protection laws.

13. Governing Law

These Terms are governed by the laws of the State of North Dakota, USA, unless local law prohibits. Disputes not submitted to arbitration will be resolved in courts located in Bismarck, North Dakota.

14. Arbitration (U.S. Customers)

• Pre-Arbitration Negotiation: Required 30-day good-faith contact before arbitration

• Arbitration Forum: AAA under Consumer Arbitration Rules

• Waiver: No class actions or representative claims allowed

• Opt-Out: Email thebiblicalman1611@gmail.com Within 30 days of first purchase, to decline arbitration

15. Changes to Terms

We may amend these Terms at any time. Material changes take effect 15 days after notice; minor edits are effective immediately. Continued use of services indicates acceptance.
